Terms & Conditions


IMPORTANT: Please read these Official Competition Rules (these “Official Rules“) before entering “Van-tastic Adventures” Competition 2009 (the “Competition“) to be conducted by The World Nomads Group Pty Limited (”World Nomads“). By participating in the Competition, each entrant agrees to be bound by these Official Rules (and any amendments thereof) and represents and warrants that they satisfy all of the eligibility requirements set out herein. Any changes to these Official Rules will be published on the World Nomads website at www.worldnomads.com.

  1. The competition will require entrants to submit a video audition of themselves demonstrating why they should be selected by World Nomads as “Van-tastic Adventurers” to produce a video documentary tour for one of the selected states and territories of Australia. One team of entrants will be selected for each of Queensland, New South Wales, Victoria, South Australia, Western Australia, Northern Territory and Tasmania (the “States“). Entry is free. No purchase by the entrants is necessary in order to take part in the Competition.
    1. The Competition is open to residents of Australia and non-residents. All non-Australian residents must however hold both a valid passport and an Australian visa that permits them to travel to and remain in Australia for the duration of the specified dates of their nominated state Adventure.
    2. All entrants may only enter as a team of one or two people and each entrant must be eighteen (18) years of age or older (each a “Participating Team Member” and together a “Participating Team”).
    3. At least one Participating Team Member must hold a current, valid, civil driving licence that has been held for at least one year and which permits the holder to drive a 4 wheel motor vehicle in the States. If the drivers licence is not in the English language, then an international drivers licence is also required.
    4. Directors, officers and employees of World Nomads or its affiliated companies, subsidiaries, agents, professional advisors, advertising and promotional agencies, associate vendors and immediate families of each are not eligible to enter the Competition.
    5. Multiple entries by each Participating Team is permitted, but the same Audition Video (see definition in Clause 3(b)(ii) below) can only be entered once throughout the Competition.
    6. All required entry information in the Competition Forms (as described below) must be completed in full and submitted online by all Participating Team Members in accordance with clause 3(b)(i) below.
    7. All Competition entries must be submitted in English. Competition entries submitted in any other languages will be rejected by World Nomads.
  2. Entry to the Competition will be as follows:
    1. The Competition is open for participation from 9.00am (Australian Eastern Standard Time (’AEST’) on 1 May 2009 and closes at 11.59PM AEST on the following dates within each of the states and territories listed below:
      1. Queensland entries – 5 July 2009;
      2. New South Wales entries – 19 July 2009;
      3. Victoria entries – 30 August 2009;
      4. Tasmania entries – 18 October 2009;
      5. South Australia entries – 29 November 2009;
      6. Northern Territory entries – 17 January, 2010;
      7. Western Australia entries – 28 February 2010.

      All entries must be received by World Nomads before the Competition closes for participation. The submission of an entry by any person will signify their acceptance of these Official Rules.

    2. To enter the Competition a Participating Team Member must:
      1. logon to the Competition website at www.vantastic.worldnomads.com and read, accept and submit the online “Entry Form and Release for Participation” signifying each Participating Team Member’s agreement to these Official Rules (the “Competition Forms“).
      2. submit a video of no more than two (2) minutes of either one or both Participating Team Members outlining what they would do on their adventure if selected and demonstrating the Participating Team Members lust for adventurous travel and personality on camera (the “Audition Video“). The Audition Video must be uploaded to http://www.youtube.com/group/worldnomads and clearly include (i) the Audition Video title (ii) which of the States the Participating Team are applying for; e.g. “Adventure on the Road, SA” or “My Big Trip, NSW”. Participating Teams may use the same Audition Video to apply for more than one State, but they must include each State they are applying for in the title (e.g. “Amanda’s Odyssey, NT, TAS, VIC”). Only Audition Videos titled in this manner will be considered for the Competition.

      The following abbreviations are acceptable for each State:

      • Victoria – VIC
      • Tasmania – TAS
      • South Australia – SA
      • Western Australia – WA
      • Northern Territory – NT
      • Queensland – QLD
      • New South Wales – NSW.
    3. To be eligible to enter, Participating Team Members must be available for all of the dates of their nominated adventure and able to attend the designated pick up and drop off cities on the dates outlined below:
      1. Van-tastic Adventure Queensland: Pick up: Cairns on 3 August 2009; Drop off: Brisbane on 14 September 2009
      2. Van-tastic Adventure New South Wales: Pick up: Brisbane on 18 September 2009; Drop off: Sydney on 30 October 2009;
      3. Van-tastic Adventure Victoria: Pick up: Sydney on 3 November 2009; Drop off: Melbourne on 15 December 2009;
      4. Van-tastic Adventure Tasmania: Pick up: Melbourne on 19 December 2009; Drop off: Melbourne on 30 January 2010;
      5. Van-tastic Adventure South Australia: Pick up: Melbourne on 3 February 2010; Drop off: Adelaide on 17 March 2010;
      6. Van-tastic Adventure Northern Territory: Pick up: Adelaide on 22 March 2010; Drop off: Darwin on 1 May 2010;
      7. Van-tastic Adventure Western Australia: Pick up: Darwin on 6 May 2010; Drop off: Perth on 17 June 2010.

      (each an “Adventure“).

  3. One Participating Team will be selected for each Adventure, a total of seven (7) teams (each a “Finalist Team“). The Finalist Teams for each Adventure will be selected by a panel of three (3) judges, who will judge the best overall entry from a review of all eligible entries. The best overall entries will be those which in the opinion of the panel of judges best demonstrate in their Audition Video how they have a lust for adventure travel and best describe what they would do on their Adventure if their Participating Team was selected.
  4. World Nomads reserves the right accept, reject or disqualify an entry at its absolute discretion. Failure to satisfactorily complete and submit the Competition Forms and the Audition Video as required in these Official Rules will result in disqualification of the entry. Entries and Audition Videos which are not reasonably pertinent to the judging criteria (described above), as determined by World Nomads and/or the judges in their sole discretion, performances that include obscenities, objectionable material, defame or infringe the privacy rights of any person, living or deceased, or otherwise infringe upon any third party’s personal or proprietary rights will be disqualified.
  5. By entering the Competition, each Participating Team Member represents and warrants that he/she is not subject to any agreement, arrangement or understanding, including without limitation, any music publishing agreement, artist agreement, representation agreement, recording agreement, production agreement or any similar or other agreement that would interfere with his/her entering the Competition, and granting any of the rights required under these Official Rules.
  6. World Nomads shall not be responsible for:
    1. failed, partial or garbled computer transmissions, technical failures of any kind, including but not limited to electronic malfunction or damage of any network, hardware or software;
    2. any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries;
    3. or any problems or technical malfunctions of any telephone network or lines, computer online systems, servers, or providers, computer equipment, software, failure of any e-mail or electronic entry to be received on account of technical problems or traffic congestion on the Internet or at any web site, or any combination thereof, including any injury or damage to any entrant’s or any other person’s computer related to or resulting from participation in or downloading any materials from the Competition.
  7. If for any reason the Competition is not capable of running as planned, including by reason of infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or other causes that corrupt or affect the administration, security, fairness, integrity or proper conduct of the Competition, World Nomads reserves the right, in its sole discretion, to cancel, terminate, modify or suspend the Competition, and to disqualify any individual who tampers with the entry process.
  8. In the event of a Finalist Team not being able to take up the Finalist Prize as detailed, World Nomads reserves the right to select an alternative Finalist Team. World Nomads’ decision is final and binding on all participants and no correspondence and/or objection will be entertained.
  9. For the avoidance of doubt, Participating Team Members acknowledge that World Nomads shall be under no obligation to use or broadcast any of the Audition Videos or other recordings and footage of their performances.
  10. The panel of judges will make their selection at World Nomads Group Pty Limited of Level 5, 24 York St, Sydney, NSW 2000. The judges’ decision is final and no correspondence will be entered into. Chance plays no part in determining the successful applicants.
  11. Each Finalist Team will be notified by email or phone and the names will be published on the World Nomads website within 14 days after selection. If any of the Participating Team Members are not immediately identifiable or contactable, World Nomads will make reasonable efforts to identify and/or contact the Participating Team. If the Participating Team has not accepted the place as a Finalist Team in the Competition within seven (7) days, the next best entry as determined by the judging panel and the corresponding Participating Team will be selected as a Finalist Team.
  12. Each of the Finalist Teams will receive the following:
    1. Return economy flights for two team members from your nearest international airport (if coming from outside Australia), or nearest major domestic airport (if coming from within Australia) into your designated van pick up city and out of your designated van drop off city to a maximum total value of AU$5,000. Should the flights your team requires exceed AU$5,000, you will be required to pay the difference. All flights will be booked by World Nomads at their discretion and are non-changeable and non transferable. No reimbursement will be offered for any flights previously booked by the team
    2. Six (6) weeks in a Van-tastic Van to be collected at the designated pick-up city and dropped off in the designated drop off city for their nominated Adventure. Features of the van include:
      1. Air conditioned cabin;
      2. Cabin seats 3 people;
      3. Cigarette lighter for CD’s, Mobile’s & Batteries;
      4. Rear protection bar;
      5. AM-FM radio;
      6. Dinette that coverts to a double bed;
      7. Spacious Single Bed in Hi-Top;
      8. Fixed hi-top roof;
      9. Storage;
      10. Sink with water pump;
      11. 2 burner gas cooker;
      12. Fire extinguisher;
      13. 2 way fridge;
      14. Dual battery system;
      15. Plus, the following camping equipment will be on loan with the van:
        • Towels and linen;
        • Sleeping bags & pillows;
        • Crockery and cutlery;
        • Cooking utensils;
        • Coffee, tea and sugar.
    3. One Thousand Australian Dollars (AU$1000.00) paid in cash into a nominated bank account towards the Participating Teams petrol costs.
    4. Access in the van to a mobile phone, video camera, lap top and editing equipment with wireless broadband and free internet/computers with editing software access at all Global Gossip cafes across Australia.
    5. A suggested Adventure itinerary. The route each Finalist Team takes from city to city is at their discretion, however Finalist Teams are provided with suggested driving itineraries and a selection of free adventure activities and experiences in the Participating Teams nominated State (details to be confirmed).
    6. Free Youth Hostel Australia (YHA) membership plus 10 nights of accommodation (based on multi-share rooms) at any YHA hostels to be used during the Finalist Team’s Adventure.
    7. Travel Insurance for each Finalist Team member for the duration of their Adventure in the van (if required).

    (items (a) to (g) above shall together form the “Finalist Prize“)

    All expenses and arrangements not expressly mentioned above shall be the responsibility of and be borne or arranged by the Finalist Team Members including but not limited to valid passports, visas, extra transport costs, phone calls and accommodation. The Finalist Teams are also responsible for all accommodation costs prior to and following the pick up/drop off dates, any camping/accommodation, additional petrol, food and drink and any other personal expenses encountered during their Adventure that is not covered as part of the Finalist Prize.

    The Finalist Prizes are non-transferable and no cash alternative is available for them. In the unlikely event that any component of the Finalist Prize should become unavailable due to unforeseen circumstances, World Nomads reserves the right to substitute a prize of equal or greater value, as determined by World Nomads in its sole discretion, without any liability to the Finalist Teams whatsoever.

  13. Award of the Finalist Prize to a Finalist Team is conditional upon:
    1. verification of eligibility and compliance with these Official Rules by World Nomads including, without limitation, each of the Finalist Team Members agreeing to and signing all appropriate release forms and/or prize acceptance agreements required by World Nomads, prior to the fulfilment of the Finalist Prize. Failure to complete, sign and return to World Nomads any of such documentation in a timely manner as required by World Nomads or any violation of these Official Rules will result in disqualification of the Participating Team as a Finalist Team.
    2. Each Finalist Team producing and delivering as directed by World Nomads the following content for the duration of their Adventure:
      1. A minimum of two (2) travel video diaries each week published in a designated YouTube group (a total minimum of 12 video diaries for the duration of the Adventure).
      2. A minimum of two (2) written travel blogs per week published on worldnomads.com journals (a total minimum of 12 travel blogs or the duration of the Adventure).
      3. A minimum of ten (10) travel photos per week published in a designated Flickr group (a total minimum of 60 travel photos for the duration of the Adventure).
      4. A minimum of one (1) podcast for the duration of the Finalist Teams Adventure (a total minimum of 1 podcast).
      5. A one (1) x 3-5 minute mini-documentary of the Finalist Teams six (6) week Adventure, focused on the Participating Teams nominated state submitted to World Nomads no later than two (2) weeks after the completion of the Finalist Teams 6 week Adventure in the van (”Adventure Documentary“). The final documentary to be loaded onto DVD and sent to: World Nomads, Level 5, 24 York Street, Sydney
      6. Such other varied or modified versions of the above works as reasonably directed by World Nomads.

      (items 14(b)(i) to (vi) shall be known as “Finalist Submissions“).

  14. Once all of the Adventures are complete, the winner will be chosen by a combination of a select panel of judges as well as votes from the wider travel community. The travel community will vote for their favourite Adventure Documentary as produced by each of the seven (7) Finalist Teams as follows:
    1. Voting will take place from 2 July – 25 July 2010 on the worldnomads.com website (the “Website“).
    2. To vote, voters will need to log on to the Website and vote online. Each voter must then cast one vote for their preferred Adventure Documentary. Only unique votes will be counted. Duplicate votes will not be taken into account.
  15. The (”Winning Team“) will win Ten Thousand Australian Dollars (AU$10,000.00) in cash plus two (2) Virgin Blue return domestic flights to any destination on the Virgin Blue network within Australia, to the maximum value of AU$500 per return flight (”Grand Prize“).
  16. All costs, expenses and arrangements associated with receiving and taking the Grand Prize not expressly mentioned above shall be the responsibility of and borne or arranged by the Winning Team and their travel companions including but not limited to valid passports, visas, airport transfers, extra transport costs or holiday/travel insurance, phone calls, accommodation, etc.
  17. Award of the Grand Prize to a Winning Team is conditional upon verification of eligibility and compliance with these Official Rules including, without limitation, each member of the Winning Team agreeing to and signing all appropriate release forms and/or prize acceptance agreements required by World Nomads, prior to the fulfilment of the Winning Prize. Failure to complete, sign and return to World Nomads any of such documentation in a timely manner as required by World Nomads or any violation of these Official Rules will result in disqualification of the Participating Team as a Winning Team.
  18. In the event of a Winning Team not being able to take up the Grand Prize as detailed, World Nomads reserves the right to select an alternative Winning Team. World Nomads’ decision is final and binding and no correspondence and/or objection will be entertained.
  19. The Grand Prize is non-transferable and no cash alternative is available for it. In the unlikely event that any component of the Grand Prize should become unavailable due to unforeseen circumstances, World Nomads reserves the right to substitute a prize of equal or greater value, as determined by World Nomads in its sole discretion, without any liability to World Nomads whatsoever.
  20. The Winning Team will be notified by email or phone and the names will be published on the Website within fourteen (14) days after selection.
  21. Each Finalist Team will be required to abide by all terms and conditions as part of the Travellers Auto Barn (TAB) van rental agreement. For clarity, a breach of the rental agreement will be considered a breach of these Official Rules. This includes providing a $2000 credit card imprint to be held as security in the event of an accident (The excess/deductible is $2000). If Participating Team members do not have sufficient travel insurance to cover such an excess, World Nomads will provide the team with an appropriate travel insurance product [at no charge] to cover this excess.
  22. To the fullest extent permitted by law, all Participating Teams (including Finalist Teams) hereby forever release and discharge World Nomads, their program partners and sponsors and their affiliates, subsidiaries, directors, officers, employees and agents (”Released Parties“), from and against any and all liability, claims, demands and causes of action for any personal injury or other loss or damage (including but not limited to indirect or consequential loss) arising out of or in connection with participation in the Competition and the acceptance or use of the Finalist Prize and Grand Prize. The Participating Team Members acknowledge that this release of liability, waiver of legal rights, and assumption of risk is legally binding on them and without limitation it includes that all Participating Team Members have released any and all claims against World Nomads resulting from any injury, or death, loss of property and general loss or damage arising out of or in connection with the Participating Team Members’ participation in the Competition, including any claims in contract, tort or under statute against World Nomads or any of its officers or employees. World Nomads reserves the right to disqualify the selected teams at its absolute discretion in the event of non-compliance or the failure to provide such releases.
  23. It is also a condition of entry into the Competition and continued participation in the Competition that Participating Team Members do not:
    1. write, say or publish any negative comments in their blogs, videos, podcasts or photos about either World Nomads or any participating sponsors involved in the Competition; or
    2. either by action or omission, bring World Nomads or any participating sponsors or the Competition into dispute or disrepute.

    If Participating Teams have any issues that need to be voiced or published, they must make all possible attempts to do so through the World Nomads team.

    1. Each Participating Team Member agrees to grant a royalty free, perpetual, sub-licensable and non-exclusive licence to World Nomads and all of its program partners and sponsors (”Licensees“) to use, modify, adapt and customise one hundred percent (100%) of all content embodied in the Audition Video, Finalist Submissions or otherwise created or developed by a Participating Team Member or Participating Team related to the Competition (the “Participation Content“).
    2. The Licensees shall be entitled to make use of the Participation Content or any part thereof in such manner as they shall in its sole discretion think fit, providing it relates solely to the Competition, including without limitation the right to make changes, alterations, substitutions and additions thereto, deletions therefrom and adaptations and rearrangements thereof and translations into any and all languages for any use. The Licensees shall also be entitled to use and exploit the Participation Content in whatever, media and format without incurring any liability to any Participating Team Member (including without limitation the requirement to pay any compensation in respect of any use or exploitation of the Participation) or making any acknowledgement as to ownership of the Participation Content.
    3. Each Participating Team Member voluntarily and unconditionally consents to any and all acts or omissions in respect of the Participation Content by the Licensees and any of their sub-licensees which would otherwise infringe their moral rights as defined in the Copyright Act 1968 (Cth).
    4. Each Participating Team Member authorizes each of the Licesees to, without any need for further consent or payment, use his/her/its name, voice, photograph, likeness, biographical data, logos, particulars (as applicable) and any or all of the Participation Content in any and all manner, media and formats now known or hereinafter invented or developed throughout the universe, in perpetuity and in all languages without limitation. Each Participating Team Member also grants to each of the Licesees all consents and permissions, including any consents and permissions under any relevant performance protection legislation that would otherwise be necessary to enable a Licensee to make the fullest use and exploitation of the Participation Content.
  24. All taxes associated with the receipt or use of any Finalist Prize or Grand Prize is the sole responsibility of the relevant prize winner. Finalist Teams and the Winners will be solely responsible for all shipping, handling, insurance and transportation costs associated with delivery of any prize (if applicable).
  25. Personal information of Participating Team Members will be collected to enable World Nomads to administer and promote the Competition and contact prize winners (if any). The personal information of Participating Team Members may be provided to others assisting World Nomads in this regard, including without limitation sponsors of the Competition, prize suppliers and deliverers, and authorities that regulate the Competition (if applicable) and all Participating Team Members consent to such disclosure. If a Participating Team Member does not truthfully provide all requested personal information, World Nomads may solely determine that such Participating Team shall not be eligible to take part in any way in the Competition or win any prize (if applicable).
  26. To the fullest extent permitted by law, World Nomads and its associated companies and agents exclude responsibility and all liabilities claims, loss and damage arising from any postponement, cancellation, delay or changes to the prize details beyond World Nomads reasonable control and for any act or default of any third party supplier.
  27. World Nomads reserves the right at any time in its absolute discretion and without prior notice to Participating Team Members:
    1. to cancel, modify, suspend or delay the Competition;
    2. to make changes to these Official Rules, whereupon all Participating Team Members shall be bound by the terms and conditions as varied by World Nomads; or
    3. to substitute, withdraw or cancel any prize without disclosing any reason therefore and without any payment or compensation whatsoever.
  28. The Participating Team Members must do all such things as may be reasonably required by World Nomads to give effect to the matters set out in these Official Rules, including without limitation, executing all documentation necessary to grant the rights to the Participation Content and the releases as described in these Official Rules.
  29. The Participating Team Members acknowledge that they may be required to enter agreements or arrangements with third party providers of Finalist Prizes (”Third Party Agreements“) and that any breach by them of any provision of a Third Party Agreement shall also be a breach of these Official Rules.
  30. The Competition and these Official Rules shall be governed by and construed in accordance with the laws of New South Wales, Australia, without regard to the conflict of laws provisions therein. The courts of New South Wales, Australia shall have exclusive jurisdiction.
